Nine Companies Stop Cuomo's Tokenized Stock Push

Nine listed companies used a 30-day SEC window to block OKXICE from tokenizing their shares, even after a federal exemption cleared the venue to trade.

“A regulator cleared it. A former governor championed it. Nine companies still kept their own stock off it. Does a company's own objection outrank the exemption that approved it?”

Andrew Cuomo wanted a 24/7 Wall Street. Nine companies skipped the invitation this week. OKXICE, the tokenized-stock venture Cuomo co-chairs, named the nine in an Oct. 15, 2026, notice. Broadcom, CoreWeave, Verizon and UnitedHealth Group lead that list1. Each filed a Notice of Issuer Objection. That is the one tool an SEC exemption gives a company. The tool lets a company keep its own stock off a venue someone else chose. These nine remove about 14 percent of OKXICE's first 63-stock roster. A federal regulator built the on-ramp. Nine companies just tested the exit ramp.

What Cuomo Promised Wall Street

Cuomo co-chairs OKXICE with Trabue Bland, an Intercontinental Exchange senior vice president. OKX and ICE announced the joint venture in June 20263. ICE owns the New York Stock Exchange. OKX brings the crypto-native trading engine. Cuomo, New York's former governor, framed the pairing as inevitable. He posted this months before the first objection landed. “This is a landmark step toward a truly global, 24/7 Wall Street, and toward keeping the future of digital finance anchored here in the United States,” he wrote on X on Oct. 5, 2026, the day OKXICE filed its SEC notice2. Bland used the same announcement to describe the stakes in builder's terms. “The ICE-OKX joint venture is a step towards building the infrastructure that will define how global markets operate in the decades ahead,” he said. He tied that ambition to scale already in hand. OKXICE hopes to broaden its offerings to the 120 million retail traders already using OKX, he said. Cuomo added a line that reads differently next to nine rejections. “I am personally excited by the prospect of the societal impact that blockchain technology can lead to: the democratization of finance, bringing basic financial services to underserved populations,” he said. His own examples, days later, were Broadcom, UnitedHealth Group and Verizon, three of the largest companies in America. The gap between his stated audience and his actual roster is where the first nine objections landed.

How an Objection Actually Works

The SEC issued its Innovation Exemption on Sept. 17, 202645. Its order runs five years. A qualifying venue can trade tokenized stock under it and skip exchange registration. SEC Chairman Paul Atkins called it a first step, with a fuller rule still to come. “The Securities and Exchange Commission is taking a significant step forward, within its statutory authority, to bring America's capital markets into the digital age by facilitating onchain trading of certain tokenized stocks through the 'Innovation Exemption,'” he said the day the order came out. Crypto traders nicknamed one condition "No Synthetics." A token must carry the same dividend and voting rights as the paper share it represents. Tracking the share's price alone falls short. A second condition aims at the company itself: 30 days' written notice to an issuer before a venue tokenizes its stock. The issuer can object in that window with only a letter. Commissioner Mark Uyeda framed the design as a controlled trial with real limits. “The Innovation Exemption will provide an opportunity to further develop the Commission's understanding of how these venues function with an eye to future policymaking,” he wrote in his own Sept. 17, 2026, statement.

Nine Companies Take the Exit the SEC Built

OKXICE sent its notice to issuers on Oct. 4, 2026. The venue published the objections it received on Oct. 151. Applied Optoelectronics gave the plainest account of its reasoning. A spokeswoman told The Wall Street Journal that tokenization's pull on the company's stock price, liquidity and volatility stayed unpredictable. She called the benefit too small to justify that uncertainty. Verizon, Broadcom, CoreWeave, Rocket Lab, UnitedHealth Group, AppLovin, Applied Digital and Cerebras Systems filed the same kind of notice. Each kept its own reasoning private. Two Latham & Watkins partners, Stephen Wink and Dan Gibbons, told The Information that the deeper worry sits in price discovery itself. Thin token trading could set prices that drift from the regular stock market's own price. An issuer gains little by inviting a second, unfamiliar venue to trade its shares around the clock7. OKXICE says the rejection stops at these nine. The venue still plans to list dozens of other companies, Nvidia and Apple among them, under the same exemption.

      Both Sides of the Exemption

Benjamin Schiffrin, director of securities policy at Better Markets, called the exemption a contradiction. The SEC wrote it into its own rule. “The SEC has said that tokenized securities are securities. But that doesn't matter if the SEC is going to exempt tokenized securities from the federal securities laws that protect investors,” he said in a Sept. 17, 2026, statement6. His second line named the design choice directly. “Today, the SEC has essentially created two regulatory regimes for stock trading,” Schiffrin said. One regime holds a listed stock to decades of disclosure and custody rules. The other holds a token of that same stock to a five-year trial. An opt-out letter is its main safeguard. Schiffrin's two lines build on each other. The first grants crypto's own claim: a tokenized security is a security. His second line takes the practical weight back out of that word. The tell sits in "essentially," a hedge that lets the SEC keep its label on the token while trimming the law around it.

Cuomo's camp answers that the opt-out is exactly the proof the design works. A company that dislikes tokenization can simply decline it, company by company, ahead of any new law from Congress. Nine declines in one week read, on this account, as the safeguard working on schedule. The tokenized-stock market itself kept growing regardless. Its total value reached about $3.5 billion by Oct. 15, 2026, up from about $680 million at the start of the year1. A regulator's exemption, a governor's pitch and a handful of corporate letters each played a part in that number. Together they decided it.

What Each Side Needs to Be True

Cuomo's case needs the nine objections to stay the exception. A rising trend would break it instead. Shrinking by double digits every quarter would turn his "24/7 Wall Street" into a smaller, thinner one. Schiffrin's case needs a token-market failure: a mispriced share, or a frozen redemption. The failure would need to loom large enough to force the SEC back to its rule before the five years run out. Both sides still lack their proof, though they share one fact already. A company's own letter decided whether a stock got tokenized this month, more than the regulator's rule did. One former governor can pitch a vision. Regulators can write a rule around it. One spokeswoman, with a one-paragraph letter, still gets the final word on her own employer's stock.

        By the numbers

        • 9: companies that filed a formal objection against OKXICE, out of its first 63-stock roster, Oct. 15, 20261.
        • 14 percent: the share of OKXICE's original roster those nine objections removed1.
        • 5 years: the length of the SEC's Innovation Exemption, issued Sept. 17, 20264.
        • 30 days: the notice window before a venue can tokenize a stock, and the window an issuer has to object4.
        • $3.5 billion: the tokenized-stock market's total value as of Oct. 15, 2026, up from about $680 million at the start of the year1.
        • 63: companies on OKXICE's first list, including Nvidia, Apple and Coinbase1.

        What to watch

Watch whether a tenth company files an objection before OKXICE's next notice window closes. The SEC's five-year trial still owes Atkins's promised rulemaking, the kind Congress's own crypto market-structure bill has yet to deliver. A single mispriced token trade, or a single smooth settlement, will tell both sides more than this week's nine letters did.
